Under the heading ‘Insolvencies’ you will find an alphabetical list of insolvencies and moratoria being conducted by De Bok Roijers Gasseling. It can be used to obtain further information about an insolvency or moratorium listed therein. No rights can be derived from the information on this website. Insofar as any third party could rely on the legal force of the insolvency reports contained on the website, this can be derived only from a copy of such report certified by the official receiver.
Since June 2010 we have included a facility that enables a creditor to file a claim in the insolvency proceedings online. Whilst a creditor is not required to do so, it is preferable to file a claim online since by doing so you will generally receive an almost immediate confirmation that your claim has been added to the provisional list of creditors, whereby in principle the VAT payable on unpaid invoices may be claimed back from the tax authorities.
Online filing of claims (preferred method)
The method for filing claims online is explained on the website: www.crediteurenlijst.nl. Should you have any questions relating to the use of the website, you should contact the relevant official receiver.
Filing a claim by post
It remains possible to file a claim by post. Letters should be addressed to the relevant official receiver c/o Postbus 21548, 3001 AM Rotterdam. If you choose to file a claim by ordinary post you should expect that it will take a (possibly significantly) longer time before the claim is added to the provisional list of creditors compared to filing the claim online. You will also need to send to the official receiver copies of the documents supporting your claim, such as invoices, confirmations of orders, contracts, general terms and conditions, etc.
If a creditor claims a priority right or any form of legal protection of rights (a lien, retention of title or guarantee, etc.) then this must be specifically indicated to the relevant official receiver. This can be done both online via the claim filing facility, and by letter sent by ordinary post.
Until such time as any verification meeting is held, the official receiver is entitled to revoke any provisional acknowledgement of a claim.
